What Do You Know about Judicial Mediation?

The Jordanian Judicial System safeguarded the rights of citizens against behavioral misconduct on the part of judges and their support staff through providing for the submission of formal complaint to the Judicial Inspection Directorate at the Ministry of Justice.
 
Pursuant to Judicial Inspection Regulations No. (47) for 2005, the inspection procedures apply to the following judicial categories, with the exception of holders of senior judicial ranks:
  1. Regular courts judges
  2. Execution judges
  3. Members of the Attorney General
  4. State lawyers assistants
  5. All staff servicing at the various judicial departments
 
· Complaints Against Behavioral Conduct of Judges
 
The complainant or his / her legal representative submits a formal written complaint at the Diwan at the Judicial Council (at the Cassation Court) addressed to the Chief Justice or at the Diwan at the Ministry of Justice to the attention of the Minister of Justice.
 
The complaint should include the complainant's name, signature, national number (if available), place of residence and clear and specific facts attributed to the judge subject of the complaint.
 
The Chief Justice of the Minister of Justice refers the complaint to the Judicial Inspection Directorate to proceed with the investigation.
 
For purposes of investigation, the inspector has the authority to issue memos requesting the summoning of witnesses as well as the use of all investigation means and files, documents and records access as needed.
 
The Inspector prepares a report pertinent to the complaint, and submits it to the Chief Justice, with a copy to the Ministry of Justice. The Chief Justice has the authority to either file the complaints or refer the dissentingjudge to a disciplinary board.
 
If, through investigating the complaint it was found that the complaint was malicious or was submitted in bad faith, the Inspector has the right to refer it to the Attorney General for prosecution so as to preserve the stature of the judiciary and the reputation of those serving in it.
 
·Complaints Against Behavioral Conduct of Clerks and Court Staff
 
Such complaints may be submitted directly to the Chief Justice, the Minister of Justice, the secretary general of the Ministry of Justice, or the chief judge of the court in which the concerned staff serves at. The complaints are referred to the Judicial Inspection Directorate for investigation in accordance with proper procedures.
