- A special pardon is considered one of the reasons for sentence remission, replacement, or full or partial reduction, in accordance with article (51) of the Penal Code.
- A special Pardon is granted by His Majesty the King upon the recommendation of the Council of Minster. Special pardons are applicable to court judgments of criminal cases that are final and are specific to the person concerned, benefiting only the person to whom the Pardon was issued for.
Procedures for Service Attainment
- The person requesting a special pardon or his / her legal representative files a special pardon request at the Ministry's diwanby submitting a plea addressed to the attention of the Minister of Justice.
- The Minister of Justice refers the request to the Judicial Inspection Directorate to look into the request and review the case.
- Based on the Judicial Inspection Directorate's review results, the Minister either rejects the motion or submits it to the Council of Ministers for approval.
- The Council of Ministers may either reject the request if it so deemed, or recommend to H.M the King the granting of a special pardon. His Majesty has the authority to grant the special pardon by dropping, replacing or reducing the penalty in full or in part.
Required Documents
- Final court judgment pertaining to the request and all that supports that the court judgment is final (original or certified copy).
- Conviction certificate.
- A reconciliation deed duly certified by the Public Security Department, Ministry of Interior / Administrative Governors, in the case a ruling was issued prior to the reconciliation.
- A medical report issued by specialized medical committees at the Ministry of Health indicating the convicted person's health status in the case of pardon request submission for health reasons.
Payment receipt for power of attorney issuance if the request was submitted through an attorney.
