What Do You Know about Judicial Mediation?

Accounting for the circumstances of the convicted person and the family's need to be close to him / her, the Ministry of Justice of Jordan cooperates with counterpart ministries at fellow countries with regard to the transfer of convicted prisoners to spend the remainder of the their sentence term in their home country (country of nationality).
 
The transfer procedures of convicted prisoners to and from the Kingdom are carried out in accordance with the stipulations of bilateral or regional agreements that govern such issues.
 
Procedures for Service Attainment
  • For Jordanian prisoners convicted outside the Kingdom:
The convicted person or his / her legal representative submits a written request to the relevant authorities at the country in which the judgment was issued stating his / her desire to serve time, or the remainder of the sentence term, at Jordanian prisons according to the agreements in force between the two sides.
 
Follow-up with authorities concerned with the transfer of convicted prisoners (head of the prisons department, ministry of justice at the country where the judgment / conviction was issued, Jordanian embassy at the country).
 
  • For foreign prisoners convicted inside the Kingdom:
The convicted person or his / her legal representative submits a written request to the head of the correctional and rehabilitation center in the Kingdom at which the sentence is being served, stating his / her desire to be transferred, place of transfer and reasons for the transfer request. In turn, the head of the correctional and rehabilitation center ratifies the request and forwards it to the relevant entities (ministry of interior, ministry of justice).
 
The transfer request should include proof of the viability of transferring judgment execution, in addition to all personal information, his / her conduct covering the duration of the time served, details pertinent the committed crime, time, place, legal description, penalty imposed, sentence term served, remaining term to be served and any decision pertaining to reducing the sentence.
 
The Minister of Justice refers the request to the International Relations Directorate to study the request and review the case.
 
Based on review results of the International Relations Directorate, the Minister decides to either dismiss or approve the request.
 
In the event the Minister of Justice approves the transfer request, the Minister of Interior is officially notified so as to complete the rest of the transfer procedures through counterpart sections at the Arab and International Police (Interpol).
 
Required Documents
1.      The judgments and rulings that were issued pertinent to the case to be transferred (a certified copyin accordance with the required authentication procedures of foreign documents).
2.      Payment receipt demonstrating that all fees and fines imposed as a result of the judgment have been paid in full (if the judgment was issued by a Jordanian court).
3.      Any relevant papers or documents that comprise the basis of the request.
4.      Payment receipt for power of attorney issuance if the request was submitted through an attorney.
